1. All Modis are thieves: This is the one in which he has been convicted by the Surat court, Gujarat, and sentenced to jail for two years on charges of criminal defamation. He has also been fined in the case and risks losing his MP (member of parliament) status unless both the conviction and the sentence are stayed by a superior court. Chief Judicial Magistrate H.H. Varma held that Gandhi was guilty of the Indian Penal Code, Sections 499 and 500. Gandhi has been granted bail and his sentence suspended for 30 days to allow him to appeal to the High Court against the decision. Gandhi had allegedly asked: “How come all the thieves have Modi as the common surname?”. A complaint was lodged against this by BJP MLA and former Gujarat minister Purnesh Modi. Gandhi allegedly made these remarks during a campaign rally in Karnataka in April 2019. He argued there was no mala fide intention on his part when he made the statement in question. The Jharkhand High Court refused to quash a similar plea filed by advocate Pradeep Modi in the Ranchi against Gandhi. Modi has sought Rs 20 cr as compensation from Gandhi. That case is still pending.
  2. RSS killed Gandhi: A case is still pending a Bhiwandi court in Thane district. Rahul Gandhi made this speech in March 2014. A case was filed by RSS functionary Rajesh Kunte. Kunte claimed that this hurt the RSS’ reputation. Kunte has been seeking repeated adjournments in the case, and has even been fined for this. In Sept, 2016, a Supreme Court bench comprising Dipak Misra and R.F. Nariman, allowed Gandhi to withdraw his plea seeking quashing of the defamation proceedings against him. The Bombay High court had earlier dismissed his plea to do so.
  3. Commander in thief: A case was filed by a BJP worker Mahesh Shrishrimal, in Mumbai in September 2018. Gandhi allegedly said this in a rally in Rajasthan. Shrishrimal claimed in his plea that Rahul Gandhi’s statements had hurt the sentiments of the Prime Minister’s supporters.
  4. Defamation case in Mumbai over remarks in Gauri Lankesh case linking it to the RSS ideology: Gandhi and Sitaram Yechury are facing trial in defamation case filed by an RSS activist and lawyer Dhrutiman Joshi. Gandhi has been granted bail after pleading not guilty in the case.
